These Terms and Conditions are governed by the laws of the Dominican Republic, specifically Law No. 385-05 on the Protection of Consumer or User Rights, along with all supplementary laws and regulations.

By accessing or using the Site, you acknowledge that you have read, understood, and accepted these Terms and Conditions without limitation and agree to be bound by them.

GENERAL PROVISIONS

To purchase products through the Site, customers must:

PRODUCTS

MONICA VARELA offers the products described on the Site in accordance with Articles 33, 34, 45, and 46 of Law No. 385-05.

The products offered are exclusively for personal and/or professional use. Customers may not purchase products for incorporation into a production or transformation process, resale, or the provision of services to third parties. Please note that we will maintain a record of purchases made through the Site. With or without prior notice, we reserve the right to cancel an order or reduce the quantity of products ordered when, in our sole discretion, the purchase violates these Terms and Conditions.

PRICES

All prices shown for products available through the Site include applicable local taxes and are stated in United States dollars. The customer is responsible for international shipping costs, which will be added to the price of the products and shown separately on the order form.

Our product prices may change without prior notice. We reserve the right to modify or discontinue any product or service at any time without prior notice. We will not be liable to you or any third party for any modification, price change, suspension, or interruption of the online service.

PLACING ORDERS

To place an order, the customer must follow the instructions shown on the Site. Before submitting the order, the customer may change or remove products from the shopping cart or cancel the entire order at any point during checkout.

If an item is in stock, the order processing time will be twenty-four (24) to forty-eight (48) hours. If an item is out of stock, the customer may request that the piece be made to order by contacting us through WhatsApp at +1 (849) 520 3113 to speak with a store representative. Production of an out-of-stock piece may take approximately three (3) to four (4) weeks.

By placing an order, the customer acknowledges and represents that they have read all instructions provided during checkout.

After the order is placed, the customer will receive a confirmation email stating that we have received it. If the customer does not receive this confirmation within twenty-four (24) hours after placing the order, they may contact us for assistance through WhatsApp at +1 (849) 520 3113.

PAYMENT OPTIONS

Customers may pay through PayPal, bank transfer, or credit card. We accept Visa, MasterCard, and American Express.

All debit and credit cardholders are subject to the validations and authorizations performed by the card issuer. If the card issuer declines the transaction or, for any reason, does not authorize it, whether before or after payment, we will not be liable for any delay or failure to deliver the order.

We process orders from Monday through Saturday, excluding non-working public holidays in the Dominican Republic, including:

We will process all orders placed outside these operating hours on the next business day. The estimated order processing time is twenty-four (24) to forty-eight (48) hours.

For preordered, out-of-stock, or customized pieces made to order, the estimated processing time is three (3) to four (4) weeks. Please note that we cannot guarantee the availability of every item. SHIPPING AND DELIVERY INFORMATION

We make domestic deliveries on business days between 9:00 a.m. and 6:00 p.m. After the order has been processed, products will be delivered anywhere in the country within a maximum of seven (7) days.

For deliveries within Santo Domingo, Distrito Nacional, we deliver the order directly to the address provided by the customer. For domestic deliveries outside Santo Domingo, we use a third-party service provider, and the customer must collect the order from the provider’s agency or location. After the customer completes the purchase, we will provide all relevant information about the service provider and its location.

We use a third-party shipping provider for all orders sent outside the Dominican Republic. International orders ship exclusively on Wednesdays, and delivery times will vary according to the date the order is placed. The customer is responsible for international shipping costs, which will be added to the final purchase price during checkout. The customer is also responsible for any applicable taxes, customs duties, or fees imposed by the destination country.

We offer free shipping on all domestic orders. International shipping costs may vary according to the destination country and the purchase amount. Shipping to the United States costs USD $50.00, and shipping to the rest of the world costs USD $80.00. International orders over USD $500.00 qualify for free shipping.

These shipping charges do not include customs duties or taxes in the recipient’s country. We recommend confirming those charges before placing your order.

Customers may collect orders from the store Monday through Friday from 9:00 a.m. to 6:00 p.m. and Saturdays from 10:00 a.m. to 2:00 p.m. Store pickup is available only at our main store, located at Avenida Abraham Lincoln, Edificio Progressus, Santo Domingo, Distrito Nacional, Dominican Republic.

UPDATES TO THE CONDITIONS OF SALE

We may revise these Conditions of Sale from time to time, so we recommend reviewing this page regularly for updates. The most recent version of these Conditions of Sale will always be available through the Platforms or upon prior request. Each new version will take effect immediately upon publication and will govern all orders for products or services placed from that date forward. Any amendment made after an order is placed will not affect that order or the customer’s relationship with us unless applicable law requires otherwise.

INVENTORY AVAILABILITY

The inclusion of a product on the Site does not guarantee its immediate availability. Availability may change without prior notice due to simultaneous sales, artisanal production, quality control, or other operational circumstances. If a product becomes unavailable after we receive an order, MONICA VARELA may offer to make the piece again, offer a similar alternative, place the order on hold, or issue a full refund of the amount paid.

SECURITY

For added security, we require a signature when we deliver an order. If you choose to waive the signature requirement, please state this in the comments section of your order. We will not be liable for lost items when you waive this requirement.

CANCELLATIONS

The system may automatically cancel an order for one or more of the following reasons:

  • An item is unavailable;
  • We cannot process the payment information;
  • We cannot deliver to the address provided;
  • The customer placed a duplicate order;
  • The customer requested cancellation;
  • The order presents a risk of fraud.

If we cancel an order, the customer will receive an email explaining the reason. We will not charge the customer for a canceled order. The customer may place a new order after a cancellation.

CARE AND MAINTENANCE OF JEWELRY

Pieces sold by MONICA VARELA require proper handling and maintenance to preserve their appearance and functionality. The customer acknowledges and accepts that materials such as sterling silver, gold or platinum plating, natural stones, and other gemstones may show variations, oxidation, gradual wear, micro-scratches, or other changes caused by normal use, environmental exposure, humidity, contact with chemicals, perfumes, cosmetics, water, perspiration, impacts, friction, or improper storage. These conditions do not constitute manufacturing defects. We recommend removing jewelry before sleeping, bathing, exercising, or taking part in any activity that could compromise its condition. Store each piece separately in a dry, protected place. Clean jewelry only with soft, non-abrasive materials. MONICA VARELA will not be liable for damage resulting from misuse, accidents, third-party alterations, lack of maintenance, or failure to follow these care recommendations. Any cleaning, restoration, adjustment, polishing, or refinishing service will require a prior assessment, will depend on availability, and may incur additional charges according to the condition of the piece.

PHOTOGRAPHS, REPRESENTATIONS, AND NATURAL VARIATIONS

The photographs, videos, and other visual representations published on the Site serve illustrative purposes. Lighting, screen settings, the artisanal nature of certain pieces, natural stones, precious metals, and manufacturing processes may cause slight differences in color, size, texture, veining, or finish between the images and the product received. These differences do not constitute manufacturing defects.

RETURN POLICY

Items sold through this Site may NOT be returned.

We allow exchanges only for new, unused, and unaltered merchandise, whether purchased directly or received as a gift, when accompanied by proof of purchase and requested within fifteen (15) days of the purchase date. The merchandise must retain all original tags and remain in its original packaging. We issue credit notes only, and each credit note remains valid for thirty (30) days from its date of issue.

Once shipped, international orders constitute FINAL SALE and do not qualify for exchange.

If a customer receives an item with any type of shipping damage, the customer must contact us immediately by email at infomv@monicavarela.com. We will ask the customer to provide a photograph of the damaged piece so that we can properly evaluate the case. The customer must send this notice within twenty-four (24) hours after receiving the order. We will not consider any claim submitted after that deadline valid.

If we confirm that an item sustained damage, we will ship a replacement to the customer. If a product becomes lost during shipping, we will also ship a replacement.

We will review the complaint and offer an appropriate solution based on the circumstances, while complying with applicable law and the conditions of this clause.

WARRANTY AND REPAIRS

Each piece has been created according to strict quality standards. We offer a warranty against manufacturing defects under normal conditions of use, provided that the customer reports them within the first fifteen (15) days after purchasing the piece. Repair times will depend on the complexity of the piece and the type of work required. ERRORS IN PRICING AND SITE INFORMATION

Although MONICA VARELA makes reasonable efforts to keep the information on the Site accurate and current, typographical, publishing, programming, or system errors may affect prices, descriptions, availability, promotions, or other product information. If an obvious error causes the Site to display a product at a clearly incorrect price, MONICA VARELA reserves the right to cancel the order before shipment, even after confirming it. In that case, MONICA VARELA will issue a full refund of any amount the customer actually paid and will assume no additional liability.

OFFERS AND PROMOTIONS

Each offer and promotion published on the Site remains subject to its own terms and conditions. By participating in a promotion, the customer fully accepts those terms and conditions.

GIFT CARDS

MONICA VARELA Gift Cards may only be used for purchases made through the company’s authorized channels. Unless MONICA VARELA expressly states otherwise, each Gift Card remains valid for three (3) months from its date of issue. The customer must use the Gift Card in a single transaction. MONICA VARELA will not refund any remaining balance or convert it into cash. If the order total exceeds the available balance, the customer must pay the difference using any payment method accepted by the Site.

INTELLECTUAL PROPERTY

This website contains material that we own or use under license. This material includes, among other elements, the design, layout, look, appearance, and graphics. Copyright protects the material that makes up this website, and we exclusively own those rights. You may not reproduce this material or any design included within it.

The operator owns, or holds authorization to use, all trademarks displayed on this website. You may not use or reproduce them. Unauthorized use of this website may give rise to a claim for damages, injunctive relief, and/or criminal liability.

The laws of the Dominican Republic govern your use of this website and any dispute arising from that use. The courts of the city of Santo Domingo will have exclusive jurisdiction over any dispute.
